Last updated: August 8, 2026. These terms govern your use of 1st Episode, an AI-assisted podcast production platform for personal brands, companies, agencies, creators, professional talent, and studio space hosts.
1st Episode helps you plan, record, edit, clip, caption, brand, schedule, and publish podcast episodes with AI assistance. The Service also includes a talent network for hiring hosts and assistant producers, and 1st Episode Spaces, a marketplace for renting podcast-ready rooms. Every show remains led and approved by real people.
By creating an account or using the Service you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. We do not permit accounts for anyone under 13, and we ask every registrant for their date of birth. If we learn an account belongs to someone under 13, we close it and delete the associated data.
Users aged 13–17 are minors. A minor may only use the Service through an approved organization’s youth program under adult supervision, and may not hire or be hired through the talent network, book or host studio spaces, withdraw funds, or exchange private messages with adults outside their program. If you are 18 or older and use the Service on behalf of a company, brand, client, or organization, you represent that you are authorized to accept these terms for it.
Nonprofits, schools, youth organizations, and other approved organizations may enable a youth program so participants aged 13–17 can take part in productions under adult supervision. The organization’s administrator must accept a youth participation acknowledgment before adding participants.
The organization is solely responsible for obtaining and maintaining every permission, consent, release, and authorization required for each minor to participate, to have their recording processed, to use their name, image, and voice, and to have content published or distributed. Before any content featuring a minor is published, an organization administrator must confirm those permissions are in place, and we log that confirmation. Organizations and participants may request removal of a minor’s content at any time; deletions are recorded in the organization’s compliance log. 1st Episode does not verify permissions on the organization’s behalf and is not responsible for an organization’s failure to obtain them.
You may hold more than one role. Features, permissions, and billing differ by role and by plan.
The Service includes a browser-based recording studio with virtual guests, a waiting room, scripts and a teleprompter, scheduling, and local capture that uploads in the background. Recording is only reliable on supported browsers and connections; we do not guarantee that any given session will capture without interruption, so you are responsible for your own backups where a session is business-critical.
Consent is your responsibility. Before recording, the person running the session must inform every participant that the session is being recorded and obtain any consent required by the laws that apply to them. Do not record anyone who has not agreed to be recorded.
You keep ownership of everything you upload or create: audio, video, transcripts, artwork, thumbnails, show notes, guest information, space listings, and profiles (“Your Content”). You grant 1st Episode a worldwide, non-exclusive, royalty-free license to host, store, transcode, process, edit, clip, caption, render, display, transmit, and publish Your Content solely to operate and provide the Service at your direction, including publishing to destinations you connect.
You are responsible for having the rights to everything you include, including guest appearances, music, logos, brand assets, and third-party material, and for making sure publication does not break any law, contract, or third-party right.
AI assists with outlines, scripts, transcripts, edits, clips, titles, descriptions, captions, thumbnails, show notes, and social posts. AI outputs are suggestions. You are responsible for reviewing, editing, and approving anything before it is finalized or published. We do not guarantee that AI outputs are accurate, complete, original, or free from bias.
Producers may send offers to hosts and assistant producers, and talent may accept, decline, or counter. Engagements may be one-off bookings or monthly retainers. Host payouts are released as soon as the recording for the booked episode is completed and do not depend on the episode being edited or published; assistant producer payouts are released when an episode is published, or at the end of each monthly retainer cycle, subject to the terms shown at booking. 1st Episode charges a platform fee on these transactions.
Talent are independent contractors of the booking party. 1st Episode is not an employer, agent, or party to any engagement, and does not guarantee work, quality, availability, or payment beyond the amounts held on the platform for a specific booking.
Space hosts list rooms with photos, amenities, an equipment tier (fully equipped, partially equipped, or bring-your-own), and an hourly rate. Producers book and pay in credits, and 1st Episode retains a platform commission. Cancellation and refund rules are shown at booking.
Space hosts are solely responsible for the safety, legality, condition, insurance, permissions, and accurate description of their space, and for any equipment provided. Renters are responsible for the space during their booking and for any damage they cause. 1st Episode is a marketplace only: we do not own, inspect, operate, or endorse any listed space, and we are not a party to the rental agreement between host and renter.
You may connect third-party accounts such as YouTube, Meta, TikTok, LinkedIn, and X. By connecting an account you authorize us to fetch the information and perform the uploads, posts, and scheduling you request. You must comply with each platform’s own terms, policies, and content limits. Those platforms may change or revoke access at any time, and we are not responsible for their decisions, outages, or takedowns.
Referral rewards are granted for genuine new signups. Self-referrals, duplicate accounts, bots, and other manipulation are prohibited. We may withhold, reverse, or revoke rewards and close accounts involved in abuse.
Branded apparel and gifts are produced and shipped by third-party fulfillment partners. Their production times, shipping, and return policies apply. By submitting artwork you confirm you own or are licensed to use it and that it does not infringe anyone’s rights.
You may not use the Service to upload, generate, or distribute illegal, infringing, defamatory, hateful, sexually exploitative, deceptive, or harmful content; to impersonate others or create misleading synthetic media of real people without consent; to interfere with, overload, scrape, or reverse-engineer the Service; or to send unsolicited communications.
To prevent trial abuse and fraud we may require phone verification and use device and browser signals to detect duplicate or automated accounts. We may limit, suspend, or terminate accounts that violate these rules.
The Service relies on third parties for payments, cloud storage and media rendering, AI models, transcription, email and SMS delivery, merchandise fulfillment, analytics, and social publishing. Their availability and terms can affect the Service, and we are not liable for their acts or outages.
You may stop using the Service at any time. We may suspend or terminate access for violations of these terms, non-payment, suspected fraud, or legal requirements, with notice where practical. After termination we may delete your content in line with our Privacy Policy, so export anything you want to keep.
The Service is provided “as is” and “as available”, without warranties of any kind. To the maximum extent permitted by law, 1st Episode is not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost recordings, or lost data, and our total liability is limited to the amount you paid us in the 12 months before the claim.
You agree to indemnify and hold 1st Episode harmless from claims arising out of Your Content, your use of the Service, your engagements with talent or space hosts, and your breach of these terms or of any law.
These terms are between you and 1st Episode, LLC. They are governed by the laws of the jurisdiction in which 1st Episode, LLC is established, and disputes will be brought in the courts of that jurisdiction. [Operator: confirm governing law, venue, and registered business address.]
We may update these terms as the product evolves. We will notify you of material changes, and continued use after they take effect means you accept them.
